Progress to stop commercial development

TEAKETTLE MOUNTAIN PRESERVATION ASSOCIATION UPDATE

Since the last Teakettle Mountain Preservation Association meeting on January 30, attended by many of you at Aliboo Farm, there has been slow but deliberate progress in the effort to stop commercial development on Teakettle Road.

Shortly after the meeting, thanks to many of you, TMPA reached the financial goal needed to fund a legal effort to stop Glassview Glacier, the "distributed hotel" glass yurt cabin glamping development high on Teakettle Mountain.

A letter offering a negotiating position, (personal, residential use of the property), was sent to Glassview attorneys of record on April 9. There was no response from them. On May 29, a lawsuit, (Complaint for Declaratory and Injunctive Relief), was filed in District Court in Kalispell. The meat of the lawsuit is the first & pages. The following 55 pages are exhibits, property descriptions from previous cases on Teakettle, etc., and probably not worth your time.

The plaintiffs in our case are residential property owners whose properties are traversed by the 20-foot prescriptive easement which is Teakettle Road. They are supported in their efforts by the resources of TMPA.

After the complaint was sent to Attorney Christopher Scoones in Bozeman, Glassview's attorney in previous communications, called our attorney, David Sandler, to inform Mr. Sandler that he hadn't been retained to represent Glassview in defense of the lawsuit.

The Complaint & Summons were served to the legal representative of Glassview on June 6th. A Lis Pendens was filed with the court on June 10th.

Since the call from Mr. Scoones, the Glassiew property on Teakettle has been listed for sale by Sotheby's in Whitefish!? We await other responses to our lawsuit with interest.

Again, we thank all of you who contributed ideas and funding which enabled TMPA to undertake support of this safety and conservation cause!

We will continue to try to keep you informed when there are new developments in this case, as well as issues with the other "threats" to the natural environment and residential nature of the east side of Teakettle Mountain.
